1. ACCEPTANCE OF TERMS
Welcome to HomeBase Benefit Program. By accessing or using our website located at www.homebasebenefit.com (the "Site"), submitting any form, or using any service offered by HomeBase Benefit ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms").
If you do not agree to these Terms, please do not use our Site or services. These Terms apply to all visitors, users, consumers, and loan officers who access or use the Site in any way.
We reserve the right to update these Terms at any time. Continued use of the Site following any update constitutes your acceptance of the revised Terms.
2. DESCRIPTION OF SERVICES
HomeBase Benefit operates a platform designed to:
• Connect consumers seeking mortgage financing with HomeBase Benefit Program loan officers in their state
• Promote transparency and ethical practices in the mortgage industry through the HomeBase Benefit program
• Provide educational content and resources related to the mortgage and home buying process
• Allow loan officers to register and be identified as members of the HomeBase Benefit Program transparency network
HomeBase Benefit Program is a referral and matching platform. We are not a mortgage lender, mortgage broker, bank, financial institution, or legal advisor. We do not originate, underwrite, fund, or service mortgage loans.
3. CONSUMER TERMS OF USE
Loan Officer Finder Form
When you submit our Loan Officer Finder form, you are requesting to be connected with a HomeBase Benefit Program loan officer in your state. By submitting the form, you acknowledge and agree that:
• The information you provide is accurate and truthful to the best of your knowledge
• You consent to being contacted by a HomeBase Benefit Program loan officer via phone, email, or text message regarding your mortgage inquiry
• HomeBase Benefit Program does not guarantee loan approval, specific interest rates, or specific loan terms
• The loan officer you are connected with is an independent professional — not an employee or agent of HomeBase Benefit Program
• HomeBase Benefit Program is not responsible for the actions, advice, representations, or omissions of any loan officer in the network
No Mortgage or Financial Advice
Nothing on this Site constitutes mortgage advice, financial advice, legal advice, or a commitment to lend. All content is provided for informational and educational purposes only. You should consult a licensed mortgage professional for advice specific to your financial situation.
4. LOAN OFFICER TERMS OF PARTICIPATION
Eligibility
To participate in the HomeBase Benefit Program network, a loan officer must:
• Hold a valid, active mortgage license in good standing in the state(s) where they originate loans
• Have an active NMLS number and be registered on NMLS Consumer Access
• Sign and submit the HomeBase Benefit Program Transparency Pledge
• Agree to these Terms of Service
• Not be the subject of any unresolved disciplinary action, suspension, or revocation by any state or federal regulatory authority
Pledge Compliance
By joining the HomeBase Benefit Program network, loan officers agree to uphold the standards of the HomeBase Benefit Program Transparency Pledge at all times. This includes but is not limited to:
• Full disclosure of all fees, costs, and compensation on every loan
• Honest, complete answers to all consumer questions
• Recommending products solely in the consumer's best interest
• Never using confusion, urgency, or pressure to close a transaction
Removal from Network
HomeBase Benefit Program reserves the right to remove any loan officer from the network at any time for any of the following reasons:
• Violation of the HomeBase Benefit Program Transparency Pledge
• Consumer complaints that indicate deceptive, misleading, or harmful conduct
• Loss or suspension of mortgage license
• Regulatory action, investigation, or sanction by any state or federal authority
• Any conduct that, in HomeBase Benefit Program's sole discretion, is inconsistent with the mission and standards of the network
Removal from the network does not create liability for HomeBase Benefit Program. Loan officers who are removed may not represent themselves as HomeBase Benefit Program pledge members.
No Exclusivity or Employment
Participation in the HomeBase Benefit Program network does not create an employment relationship, partnership, joint venture, agency, or franchise between HomeBase Benefit Program and any loan officer. Loan officers are independent professionals and are solely responsible for their own compliance with all applicable laws and regulations.
5. TEXT MESSAGE COMMUNICATIONS
By providing your phone number and consenting to text messages on any form on our Site, you agree to receive text messages from HomeBase Benefit Program as described in our Privacy Policy. Standard message and data rates may apply. You may opt out at any time by replying STOP. You may text HELP for assistance.
HomeBase Benefit Program will not share your phone number with third parties for their independent marketing purposes without your consent.
6. INTELLECTUAL PROPERTY
All content on the Site — including but not limited to the HomeBase Benefit Program name, logo, pledge documents, written content, design elements, and the "HomeBase Benefit Program" trademark — is the exclusive property of HomeBase Benefit Program and is protected by applicable copyright, trademark, and intellectual property laws.
You may not reproduce, distribute, modify, publicly display, or create derivative works from any content on this Site without our prior written permission. Loan officers in the network are granted a limited, non-exclusive, non-transferable license to use HomeBase Benefit Program branding materials solely to identify themselves as pledge members, subject to our branding guidelines.
7. USER CONDUCT
By using this Site, you agree not to:
• Submit false, misleading, or fraudulent information through any form or communication
• Impersonate any person, entity, or HomeBase Benefit Program transparency pledge loan officer
• Use the Site for any unlawful purpose or in violation of any applicable laws or regulations
• Attempt to gain unauthorized access to any portion of the Site or its related systems
• Use automated tools, bots, or scrapers to access or collect information from the Site
• Post or transmit any content that is defamatory, harassing, obscene, or harmful
• Falsely claim pledge membership or misrepresent your affiliation with HomeBase Benefit Program
8. DISCLAIMER OF WARRANTIES
THE SITE AND ALL CONTENT, SERVICES, AND MATERIALS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. HomeBase Benefit Program MAKES NO WARRANTY THAT:
• The Site will be uninterrupted, secure, or error-free
• Any loan officer referral will result in loan approval or favorable loan terms
• The information on the Site is accurate, complete, or current
• Any loan officer in the network will uphold the HomeBase Benefit Program Pledge in every transaction
YOUR USE OF THE SITE AND RELIANCE ON ANY INFORMATION OR REFERRAL IS ENTIRELY AT YOUR OWN RISK.
9. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, HomeBase Benefit Program, ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, INCLUDING BUT NOT LIMITED TO:
• Any loan terms, fees, or outcomes resulting from working with a referred loan officer
• Any act or omission of any loan officer in the network
• Loss of data, revenue, or profits
• Any unauthorized access to or use of our servers or any personal information
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED ONE HUNDRED DOLLARS ($100.00). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY, SO THE ABOVE MAY NOT APPLY TO YOU.
10. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless HomeBase Benefit Program and its officers, directors, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Site or services; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) any false or misleading information you provide.
11. THIRD-PARTY LINKS AND SERVICES
The Site may contain links to third-party websites or services. HomeBase Benefit Program does not endorse, control, or assume responsibility for any third-party content, products, or services. Your use of any third-party site is governed by that site's own terms and policies.
12. PRIVACY
Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Site, you consent to the collection and use of your information as described in the Privacy Policy, available at www.homebasebenefit.com/privacy-policy.
13. GOVERNING LAW AND DISPUTE RESOLUTION
These Terms shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these Terms or your use of the Site shall first be subject to good-faith negotiation between the parties. If not resolved within thirty (30) days, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, with proceedings conducted in Nashville, Tennessee.
You waive any right to participate in a class action lawsuit or class-wide arbitration against HomeBase Benefit Program.
14. MODIFICATIONS TO THE SITE AND TERMS
HomeBase Benefit Program reserves the right to modify, suspend, or discontinue any aspect of the Site or services at any time without notice or liability. We also reserve the right to amend these Terms at any time. The most current version of the Terms will always be available on the Site. Your continued use of the Site following any modification constitutes your acceptance of the updated Terms.
15. SEVERABILITY
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it enforceable.
16. ENTIRE AGREEMENT
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Keep The Cash regarding your use of the Site and supersede all prior agreements, representations, and understandings.
